DUTIES:
In the subject areas assigned to the Office of Regional Counsel and under the general supervision of the
Assistant Regional Counsel and the Regional Counsel, the incumbent will
litigate administrative hearings, provide guidance and advice to clients, draft
legal opinions and briefs and handles administrative processing of matters
related to Federal tort Claims Act, Privacy Act, Freedom of Information Act, VA
fiduciary matters, Federal Employment Laws and Regulations, loan guaranty,
collections, and ethics.

Principal Duties:

  • Responsibility for
investigations, settlement, analysis, and recommendation as to the proper
course of action in the most difficult and complex cases filed.

  • Under supervision of the
Assistant Regional Counsel or a Senior Attorney, serves as principal trial
attorney in cases related to Title 5 U.S.C adverse action employment; Equal
Employment Opportunity Law; probate actions; invol! untary civil commitments;
Guardianship matters; and Debt, garnishme! nt, and third party collections.

  • Represents the VA before the
Merit Systems Protection Board (MSPB); the Equal Employment Opportunity
Commission (EEOC); and Employee Compensation Appeals Board.

  • Responsible for administration
of Federal Tort Claims Act matters which cover claims that involve injury, or
death (with emphasis on medical malpractice cases) or damage to, or loss of
privately owned property.

  • Provides legal advice and
opinions on a wide variety of administrative and legal matters such as labor
management relations and hospital administration.

  • Provides all necessary legal
services in the acquisition, conveyance, ownership, management, liquidation,
sale, eviction, transfer, assignment, rental or other disposition of real or
personal property.

Bar Membership Requirement:
Possess a Bachelor of Law or Juris Doctor degree from a law school or be awarded such before appointment. Be a member in good standing of the bar of a state or T! erritory of the United States, or the District of Columbia. Where the d! uties of the position call for appearance in court, be a member in good standing of the bar, or be eligible for admission to the bar of the state or Territory of the United States or the District of Columbia which they will serve.
