Ameritas is looking for our next VP, HR Counsel to join the Legal team. As the VP, HR Counsel, you will manage human resource and benefit legal issues throughout the Ameritas enterprise and help prevent or minimize exposure to legal liability in these areas. You will be a subject matter expert providing legal counsel and advice to Ameritas managers on human resource and benefit issues, both on a strategic and day-to-day operations levels. You will give proactive advice and counsel to help ensure that exposures to risk are identified and managed including monitoring human resource and benefits regulatory and legal activity potentially impacting the company. This role will prosecute and defend all human resource and benefits charges and other litigation as assigned and ensures compliance with all state, federal, and local laws in these areas. The VP, HR counsel will act as the company representative and regularly speaks on Human Resources and Benefits issues.
Essential Functions
In-house education
- Manage Ameritas Companies human resources and benefits law practice. In this capacity, the incumbent acquires and continually keeps current in all enterprise policies, procedures, and statutory requirements affecting Ameritas employees and agents.
- Work with Human Resources in responding to any DOL, OFCCP or other regulatory agency audits, reviews, or requests for information.
- Oversee and review all human resource and benefit related contracts entered into by the company as well as prepare new contracts and other legal documents as necessary.
- Direct/guide business partners in employment classification issues specific to the insurance and financial services industry.
- Share responsibility for establishing, maintaining, communicating, and deploying policies and procedures that support lawful human resource and benefit practices in the financial services industry.
- Conduct training for human resource professionals and managers related to employment laws and sound management practices that lead to reduced liability and exposure for the company.
- Serve as part of M&A legal team conducting due diligence, negotiations, contract drafting, and other responsibilities as assigned.
- Work closely with the SVP & General Counsel and the SVP, Human Resources, as well as their direct reports, on all human resource and benefits legal issues, including introduction, termination or consolidation of enterprise policies and procedures and benefit plans as well as providing daily guidance on issues involving competition, immigration, leave, discipline, termination (RIF, ERW, etc.), disability, COBRA, taxes, wage payments and garnishments, records retention, discrimination, etc.
- Monitor and advise Ameritas on human resource and benefits regulatory issues and class actions that have potential or actual impact on our associates and contractors, thereby impacting our business.
- Establish best practices and templates for use in employment related matters.
- Oversee, prosecute and defend all human resource and benefit agency charges and litigation involving the company. Where agency complaints, demands, or litigation is involved, the legal work is usually complex and fact intensive and requires a high degree of original and constructive legal endeavor for their solution.
- Respond to subpoenas, complaints, and administrative agency investigations.
- Practice preventive law and supports all business units by identifying issues, researching and analyzing laws, and providing quality legal advice on diverse legal issues involving human resource and benefit matters. Conducts legal research and analysis and provides legal opinions.
- Manages outside legal counsel as required to ensure competency of work, adherence to budget, and meeting deadlines.
- Ensure Compliance with all applicable federal, state and local employment, compensation, and benefit laws.
- Immediately report known or suspected violations of laws, regulations and company policies, practices and procedures to the company's compliance officer.
- Other projects and/or duties as assigned.
- Bachelors degree in a related field or equivalent work experience required. Juris Doctorate required.
- 10+ years of progressive experience in the practice of employment and benefits law and litigation required
- Licensed attorney to practice law in one or more states
- Experience in corporate, governmental bodies, mergers and acquisitions, insurance and securities law is a plus.
- Ability to learn the financial services industry, the enterprise's and assigned department's business and operations, and of the inter-relationships of the numerous legal issues and problems that can arise.
- Experience with (Lexis) or other systems needed for legal research required.
- Ability to present and resolve sensitive issues with senior executives and/or directors essential.
- Solid strategic planning and capabilities a must.
- Strong financial acumen and business financial principals required
