We are looking for a junior to mid-level attorney to become a member of our team in Omaha, NE reporting to the Chief Counsel â€" Litigation to assist with oversight an d management of the Company’s claims and litigation and to assist with reviewing, drafting and negotiating engineering contracts and to provide legal advice during the delivery of projects and general legal advice on other matters for the company. More specific duties include but are not limited to:

  • Manage litigation, arbitration, and mediation by and against the Company on matters ranging from professional liability, breach of contract, change orders, disputed payments, delay claims and other claims arising from the performance of our projects and the conduct of our business.
  • Select, manage and coordinate outside counsel litigating cases on the Company's behalf, including managing case budgets and legal spend.
  • Review and approval of outside counsel invoices, costs and vendor invoices.
  • Conduct early case assessments, develop case strategies and plans, prepare and/or review the Company's written submissions, build the Company' s case, prepare the Company's witnesses and trial presentation, and, in appropriate cases, set and carry out the Company's settlement strategy.
  • Utilize the Company’s internal claims management system.
  • Negotiate with opposing counsel concerning settlements and resolution.
  • Monitor, approve and process claim resolution costs.
  • Support and assist Company employees in resolution of claims.
  • Assist outside counsel with discovery responses, document collection, and investigation.
  • Issue and manage litigation holds.
  • Review, analyze and develop response strategies for subpoenas, open records requests, and related legal processes.
  • Advise and assist with fee collection issues, retain outside counsel when necessary, and provide guidance concerning contract financial issues and disputes.
  • Draft various construction industry contracts and legal documents.
  • Assist in conducting risk assessment of contracts and pr ojects.
  • Assist and participate in negotiations involving contacts and contractual terms.
  • Prepare and present legal training and risk management seminars to company staff.
  • Advise and assist with project management on contract administration and claims avoidance.
  • Provide general legal advice and guidance upon request.
  • Serve on committees and project teams to provide relevant legal advice and guidance.
  • As needed and depending on availability, it is also anticipated that this position will work with other Legal Department attorneys on non-litigation special projects to be determined.
  • May provide legal support to projects during delivery, risk management through on-going legal engagement and training, and the management of changes and claims.

Qualifications
Required Qualifications
• JD Degree
  • The succ essful candidate will have 4-5+ years of legal experience preferably including litigating complex matters for the architecture, engineering or construction industry within a law firm or management of claims and litigation in an in-house legal department or professional liability insurer.
  • Significant involvement and skill in (i) drafting and editing legal memoranda and correspondence, (ii) briefs, (iii) legal research, (iii) cost and schedule analysis , and (iv) organizing and analyzing documentary records.
  • Proven strength in oral advocacy.
  • Knowledge of US courts and arbitration rules and processes.
  • Experience in developing strategy and managing high risk/stakes disputes.
  • Proactive and focused on continuous improvement.
  • Member in good standing of the Nebraska state bar or ability to be licensed in Nebraska as an in-house lawyer.
  • Results-oriented, highly collaborative, pragmatic, flexible, takes initiative, and leverages systems and processes to make strategic decisions.
  • Ability to build partnerships internally.
  • Sound legal reasoning, thoroughness, and excellent legal writing skills and presentation skills.
  • Capable of building teams and effectively operating within teams.
  • Excellent previously demonstrated negotiating skills.
  • Ability to identify and manage risk inherent to projects in the engineering/architecture consulting industry.
  • Proactive and able to drive results.
  • Ability to think on feet.
  • Ability to personally interact with clients, contractors and colleagues.
  • Strong people skills and ability to lead through persuasion.
  • Location in Omaha, Nebraska.
