Under the supervision of the Director and Deputy Director of the Office of Public Guardian, this position (serving Omaha through all Eastern Nebraska OPG Service area) provides legal representation for the Office of Publi c Guardian (OPG) within the realm of the guardianship/conservatorship actions; gives legal support to Associate Public Guardians (APG's); assists with information and support to attorneys retained by the OPG to represent wards or protected persons outside the parameter of guardianship or conservatorship; contributes technical support for legal issues and legal interests of wards and protected persons; and facilitates compliance with model practices and court rules.
Examples of Work
Legal representation duties may include: Conferring with Associate Public Guardians, wards/protected persons, plaintiff attorneys, defendant attorneys, and other interested parties to exchange and prepare information on the facts and status of OPG guardianship and conservatorship cases. Researches legal precedents, case reports, and other legal documents to collect information for case preparation; prepares initial drafts of correspondence, motions, pleading s, orders, affidavits and other legal documents; represent the OPG in guardianship and conservatorship legal actions in court, as directed by the Deputy Director of the Office of Public Guardian.
Qualifications / Requirements
REQUIREMENTS: Baccalaureate degree from an accredited institution with a focus on social work, counseling, psychology, gerontology, related behavioral science, or client support business services and at least two years' experience in a discipline pertinent to the provision of guardianship and conservatorship services, developmental disabilities, and/or persons with disruptive behaviors; AND a Juris Doctorate from an accredited law college; able to practice law in Nebraska.
PREFERRED: Education including a supervised field placement or civil clinic law experience providing social casework, counseling, or legal services to elderly, vulnerable or dependent adults, minors and their families.
OTHER: No felony conviction; no misdemeanor conviction involving moral turpitude; possession of a valid Nebraska Motor Vehicle Operator's license or alternate means of transportation; excellent credit history; highest personal and professional references that would support a court finding of suitability to qualify for appointment as a guardian and conservator. Individual chosen for the position will be subject to an extensive background check.

Knowledge, Skills and Abilities
Demonstrated analytical skills with the ability to think logically and arrive at sound conclusions: to identify issues as they arise and address them proactively; to prioritize tasks and accomplish multiple projects simultaneously. Working knowledge of the Office of Public Guardian goals, objectives, and statutory requirements; medical and psychiatric terminology and health care laws and regulations that may impact APG decision making and OPG wards' medical c are. Knowledge of the techniques of preparing/drafting legal documents and forms; the principles and practices of guardianship and conservatorship administration; judicial procedures and rules of evidence; the principles and practices of legal research; the procedures of trial and administrative hearings.
