Under the direct supervision of an Attorney III, provide basic legal support to the Lottery and Charitable Gaming Division of the Nebraska Department of Revenue (Division) in the research, administ! ration, and enforcement of the various charitable gaming acts, including those governing keno, pickle cards (also known as pull tabs), lotteries and raffles, bingo, and gift enterprises. While the incumbent's primary focus will be charitable gaming law, the incumbent will, under the direct supervision of an Attorney III, also provide basic legal support for the Nebraska Lottery and the Nebraska Athletic Commission. The incumbent will be under-staffing at an Attorney II position and must demonstrate the ability to perform at the Attorney II level within one year.
Examples of Work:
Confers with legal associates, agency staff, local government officials, plaintiffs, defendants, and other interested parties to exchange and prepare information on the facts and status of a case or on other legal/administrative or issues. Researches legal precedents, case reports, and other legal documents in accordance with supervisory instructions to gather information for a ! case preparation and to facilitate the administration and enfo! rcement requirements and needs of the agency. Assists in the drafting of correspondence, motions, pleadings, and findings of fact, conclusions of law, rules, orders, and other legal documents to provide legal assistance to other legal counsels or agency management. Interprets and explains court decisions, administrative rules, and other legal statements to respond to inquiries from interested parties and to ensure adherence to them by agency staff. Assists in the review of contracts in reference to statutory authority, legal form, general contract principles and compliance with specific State and federal regulatory requirements. Analyzes current and proposed legislation, agency policies, and procedural statements to assess their legal appropriateness and impact. Represents the Division at administrative hearings, especially license denial hearings. Assists in drafting and analyzing proposed legislation, agency policies, regulations, and procedural statements at the directio! n of the Attorney III; prepares fiscal notes and legislative summaries. Prepares legal memorandum on issues involving charitable gaming activities and other areas of concern, including tax law and contract law. Communicates to licensees statutory, regulatory, or other policy and licensing changes. Assists the supervising Attorney III in the planning and implementation of charitable gaming policy-related assignments and performs oversight as needed or directed. Coordinates and/or participates in the Division's education, outreach, and informational efforts, including: conferring with Revenue associates, supervisors, managers, directors, and the Tax Commissioner, other agencies (state and federal), taxpayers, interest groups, and private organizations to discuss charitable gaming tax programs and policies, resolve problems, and explain the issues involved; conducting formal presentations to licensees or prospective licensees; developing training seminars; meeting with county,! city, village officials regarding keno related issues; conducting info! rmal information sessions as requested. In conjunction with the other Division staff, monitors the activities of keno licensees including their regulatory compliance; acts as the Division's primary keno liaison. Prepares information as requested by the Director, Attorney General, and Tax Commissioner regarding tribal-gaming related issues; provides support as needed to the supervising Attorney III, Director, and Tax Commissioner in the negotiation, formulation, and implementation of tribal-state gaming compacts; tracks, analyzes, and explains tribal gaming developments. Researches and prepares written correspondence, or coordinates the research and preparation of written correspondence, in response to inquiries (mail, telephone, email) regarding charitable gaming activity. Reviews draft versions of Nebraska Lottery instant ticket games; reviews draft Nebraska Lottery rules for contests and promotions; provide input and revisions as required. Assists the supervising Attorney! III in the planning and implementation of Athletic Commission-related assignments. Develop the knowledge, skills and abilities necessary to perform at the Attorney II classification level.
Qualifications / Requirements:
REQUIREMENTS: Graduation from an accredited school of law and admission to the Nebraska Bar.
Knowledge, Skills and Abilities:
Knowledge of: the principles and practices of legal research; the techniques of preparing and drafting legal memoranda or other legal forms. Skill in: preparing summaries, legal analysis, findings and conclusions, and other legal documents; communicating with members of the public. Ability to: quickly understand a complex body of law; prepare and communicate basic facts and arguments and persuade others to accept the viewpoint presented; formulate legal opinions and recommendations based on legal research and investigations; identify critical elements of legal questions or issues ! and select appropriate course of action; prepare/draft answers to inqui! ries received from members of the public and other non-attorney employees; interpret and apply statutes, case law, decisions of a court/administrative hearing, or other administrative rules and policies.
