Negotiate and prepare multiple forms of agreements with utilities, public agencies, and other private entities who wish to use the Railroad's property ! for wirelines, pipelines, drainage, private roadways and other similar or related temporary uses in such a manner to ensure the safety and integrity of the Railroad's property.
This position is assigned to the Real Estate area within the Finance Department. This position will be filled as an Assistant Manager or Manager a band B levels, depending on experience. This position reports to Renay Robison-Scheer, Director Real Estate.
Accountabilities:
Negotiate with customers, engineering firms, governmental agencies, property owners, appraisers, attorneys, environmental specialists, utility companies, and other involved third parties the terms and conditions for utility and road crossing agreements, rights of entry agreements and other related agreements, in a manner to maximize income, reduce liability exposure and conform to Company Operating, engineering and safety requirements and practices. Maintain such license and contract records with update! s and changes as required.
Maximize income by ensurin! g that all contracts and licenses provide for highest appropriate fees through the use of internal and external valuation resources. Collect delinquent rentals and evict licensees in default; authorize bills payable/bills collectible.
Direct, maintain and coordinate Engineering review and approval of new utility and road crossing and encroachment applications as well as approvals from field managers, fiber optics, Law, signboard managers and operating personnel.
Resolve wireline, pipeline, drainage, road crossing and right of entry issues and disputes on a system wide basis.
Serve as back-up for other Managers and mentor for new employees. Assist in maintaining training and procedure manuals.
Required Education, Training, Experience or Skills:
A Bachelor Degree Degree in Finance, Accounting, Pre-law, Real Estate, Business, or Engineering preferred.
3 year(s) experience / knowledge of the following legal areas . Profici! ent at contract preparation; review of title opinions; knowledge of regulatory requirements
3 year(s) experience / knowledge in Real Estate . Real Estate Principals and Practices; Real Estate Appraisal; Real Estate or Business Law; Surveying; and Map Reading
Proficient analytical and problem-solving skills
Proficient communication skills . Excellent verbal and written communication skills required
Proficient Microsoft Suite skills . Proficient in the use of Microsoft Suite products
Proficient time management skills . Position requires independent work and management of multiple tasks and projects simutaneously.
Preferred Education, Training, Experience or Skills:
3 year(s) experience / knowledge in Engineering . Profiecient at map and print interpretation; understanding engineering designs and specifications; able to read legal descriptions and surveys
3 year(s) experience / knowledge in Operating Pra! ctices . Familiarity with operating policies and practices, safety rule! s, state, local, and federal regulations to ensure compliance
