Location: Omaha, Nebraska

Ensure Union Pacific is in compliance with rapidly evolving federal and state rules governing electronic discovery. Provide guidance to all Union Pacific in-house and retained legal teams to reduce expense and risk of spoliation. Lead the evaluation, development and implementation of leading-edge technology, best practices, training, and education. Avoid millions of dollars of annual costs from using outside vendors.

This position is assigned to the Law Department and will be administered at a band C level.

Preference will be given to candidates that have at least 5 or more years of proven business experience in the area of legal support and technology.

Accountabilities:
Strategically partner with legal counsel for all types of litigation including complex commercial litigation, regulatory proceedings, civil actions and personal injury matters to determine ediscovery strategy. This includes primary accountability for electronic discovery results in over 125 cases per year including the company's most complex and high risk cases.

Lead and manage a team of legal professionals and IT specialists in the development and application of a reasonable, defensible electronic discovery response plan that includes the identification, preservation, collection, analysis, review and processing of information using state-of-the-art forensic technology. Achieve annual savings versus an outsourcing model in the range of $10-20 million.

Directly engage other departments as required to meet litigation requirements, offboarding protocols, and knowledge management.

Manage a multimillion combined OE and capital budget supporting the ediscovery program.

Identify and propose new litigation support system enhancements to satisfy evolving legal challenges and strategies. Evaluate and acquire additional technology and vendor support to meet discovery demands due to rapidly changing regulations and case law.

Identify and report to the Chief Compliance Officer regarding the annual Compliance Risk Assessment for Union Pacific's enterprise electronic discovery program.

Execute and update legal holds for all matters managed by the Law Department. Manage ongoing process to update and inform custodians, including off-boarding notices for all impacted matters and employees. Conduct periodic audits of legal holds processes.

Manage Union Pacific's engagement with third party litigation support vendors executing electronic discovery. Collaborate with legal counsel and other experts to ensure the defensibility of electronic review practices. Ensure adequate resources are available to meet growing demands and deadlines.

Train and support in-house and retained counsel for meet and confer conferences as it relates to Union Pacific's systems and technology. Provide direction on form of production, protective conditions for sensitive information and burden.

Effectively deploy legal and IT staff, in-house technology, and vendor resources to meet discovery obligations to achieve year-over-year improvement in cost savings, in addition to avoiding the risk and cost of spoliation sanctions.

Identify, collaborate and support the preparation of Union Pacific company representatives and experts as electronic discovery witnesses, including review of technical statements used in the preparation of affidavits.

Collaborate with Union Pacific's National eDiscovery Counsel in all major, large scale and high risk litigation. Develop and deploy training and education materials for all internal Law personnel and hundreds of retained counsel firms.

Collaborate in the development of Company policy regarding the use and monitoring of electronic systems and information.

Collaborate with the General Solicitors, General Law attorneys, and AVP Claims to develop and implement legal hold and preservation protocols for each legal practice area to minimize disruption to employee clients while meeting legal obligations.

Provide consultation for the General Director of Data Security, Director of Records Management and General Director of the National Claims Center regarding best practices for preservation, collections, disposition, and investigations involving electronically stored information. This includes Union Pacific's email environment, collaborative document stores, and various repositories of structured data. Represent the Law Department on the Company's Data Governance Board.

Required Education, Training, Experience or Skills:
A Bachelor Degree , prefer a degree in Paralegal Studies, Information Technology, or Business Administration.

Preferred Education, Training, Experience or Skills:
A post-graduate degree (MBA, JD, etc..) or higher

5 year(s) experience / knowledge in Information Technology , specifically UP Systems.

5 year(s) experience / knowledge in the Law Department , specifically legal business processes.
