Responsible for foreclosing processing, bankruptcy processing and adverse actions for mortgage loans services nationwide from initiation to conclusion within established policies, procedures, and regulations for all applicable investors and four different types of insurers. Acts as a liaison to internal and external parties to ensure all key elements, paperwork, or issues are resolved in a timely and accurate manner.

Position Accountabilities

1. Reviews and analyzes more complex bankruptcy documents, takes appropriate action, files required forms with Bankruptcy Trustees, implements court orders and directives, consults with attorneys, as needed, and negotiates payment arrangements with debtor’s attorneys.

2. Works with Payment Processing Department to apply payments or reject them according to court plans. Also works with other areas within the Bank to resolve customer problems.

3. Performs analysis on bankruptcy accounts to determine if funds have been appropriately applied and makes recommendations for corrections.

4. Handles and resolves foreclosure and bankruptcy exception items involving Investor Reporting, Risk Management, Audit, and the Accounting/Controller’s area.

5. Counsels customers in foreclosure and bankruptcy and determines if repayment arrangements or loss mitigation options are feasible based on financial analysis. Accurately prepare reinstatement and payoff quotes at the requests of customers.

6. Reviews new foreclosures submitted by the Mortgage Collection Department for appropriate pre-foreclosure work, prepares and submits appropriate information and documentation to the attorney for the state in which the property is located.

7. Monitors foreclosure and eviction cases to ensure appropriate legal actions is being taken and completed within investor and insurer timeframes. Provide accurate sales bid instructions to ensure the maximum sales proceeds are received at the time of sale.

8. Reviews daily work lists to request status updates, provide information and document any delays. Notify necessary investors and insurer of status requests per guidelines to avoid any penalties.

9. Handles the settlement of outstanding deficiencies and approves vendor billings.

10. Reviews adverse actions and determines action. Process referral action through legal desk and/or outside legal counsel and monitoring through closure.

11. Assists with the training of the Delinquency/Foreclosure Processor I employees.

12. Performs other duties as assigned.

Job Specifications

Req Education or Equivalent Experience

  • High school diploma or equivalent combination of education and experience
  • College degree preferred and may substitute for experience
Required Experience
  • One to three years of experience in mortgage loan servicing
Field of Experience
  • Good knowledge of mortgage collection/servicing requirements
  • Good knowledge of foreclosure law as it pertains to real estate, mortgages and deeds of trust
  • Knowledge and good understanding of Fair Debt Collection Act, Collection Laws and Fair Credit Reporting Act
  • Knowledge of loss mitigation//foreclosure/bankruptcy procedures/paralegal and title experience preferred
  • Knowledge of MS Office software, including Word, Excel, Outlook, Windows, and related tracking applications
